$13.7 Million Verdict in Fatal Test Drive

A jury returned a verdict for $13.7 million in a wrongful death suit stemming from a test drive gone horribly wrong.

On August 4, 2004 an Illinois man walked into a BMW dealership and asked to test drive a car. The salesman took the man out for a drive. The salesman was sitting in the passenger seat when the BMW clipped a car in front of it while making a left hand turn. The salesman was ejected from the car and was pronounced dead an hour and a half later.

Witnesses testified that the BMW was traveling around 95 miles per hour at the time of the crash.

Although the defense asserted that the salesman’s own negligence contributed to his death by telling the driver to go ahead and “open it up,” the jury found in favor of the plaintiffs.
